Election May Make Sullivan Case Moot

If a hearing in Bartow County Superior Court doesn't occur before the July 31 election, the civil case against Anna Sullivan would be moot, both the plaintiffs and defense say.

If a hearing into the legality of Anna Sullivan’s appointment to the Bartow County Board of Education isn’t held before the July 31 primary election, the whole issue will be moot, said one local resident who filed the complaint against Sullivan in Bartow County Superior Court. “If the judge does not delay a hearing, a final decision, longer than July 31, then we reasonably expect her to be removed from the board based on our understanding of the law,” said Paul Nally who, along with Gail Engelhardt, filed the lawsuit against Sullivan. “If opposing council tries to muddy that water and introduce facts that are arguable but not (the) law, the judge could set a jury trial at the next available date. That likely would happen after July 31.” …

Tea Party Director: Board Made 2 Illegal Appointments

Bartow County Tea Party Director Gail Engelhardt released a statement along with two letters requesting investigations of alleged voter fraud by the county school board.

Letters Bartow County Tea Party Director Gail Engelhardt sent to the grand jury and U.S. Attorney allege a "serious violation of voter fraud" by the county school board. The move follows a successful bid for a Superior Court hearing to determine if Post 5 representative Anna Sullivan, who was appointed in February, can retain her seat and seek election in November. Engelhardt alleges in the letters, attached as .pdfs, that Sullivan's is the second appointment in about six years that violated a legal requirement for a special election to fill a vacant seat. Judge Rules for Plaintiffs in Sullivan, BOE Case

Superior Court Judge David Smith ruled there is enough evidence to proceed to a hearing.

Bartow County Superior Court Judge David Smith ruled today there is enough evidence to proceed to a hearing to determine if appointed Bartow County School Board member Anna Sullivan can retain her seat. Smith also denied a motion dismissing the case based on the fact that plaintiffs Jerry Nalley and Bartow Tea Party Director Gail Engelhardt do not live in Sullivan’s district. “Any citizen in the county of Bartow has the right to bring an action against a public official,” the judge said. School Board Member Ordered to Court

A Superior Court judge summoned Bartow's Post 5 representative Anna Sullivan to a civil hearing set for June 13 following a lawsuit filed by the Bartow County Tea Party and Paul Nally.

A Bartow County school board member has been ordered to appear in court to answer allegations she's unlawfully and unconstitutionally serving as the District 5 representative. Following the latest round of budget cuts and the school system's proposal to increase property taxes, individuals and local political parties expressed concerns on the validity of the board's February appointment of Anna Sullivan to fill the unexpired term of Larry Parker, who resigned to head up Bartow's new academy. As a result, elections officials called a July special election to fill Parker's unexpired term; Sullivan and Greg Bowen have qualified to seek the District 5 seat in both the special election and Republican primary, both set for July 31. County School Board Seat Opens in July Special Election

BartowPolitics.com yesterday questioned the validity of Bartow Schools' appointment of Anna Sullivan, but officials say the board was within its rights.

A special election in conjunction with the July primary will decide the District 5 representative on the Bartow County Board of Education. Following questions on the validity of the recent appointment of Anna Sullivan, Elections Supervisor Joseph Kirk said yesterday officials will call for the July 31 special election in about two weeks. Following Larry Parker's Dec. 31 resignation, the board appointed Sullivan to fill the seat through the end of the year.
