Updated: Man Shot by Deputy Had AR-15

Police scanner traffic and a deputy's report reveal details of an officer-involved shooting that injured one man.

The man shot by a deputy activated his truck's bright lights, blinding the officer, and later was found with an AR-15 by his side, according to the incident report authorities today provided to Cartersville Patch.

Following reports of shots fired at an Adairsville home, the deputy pulled over Nelson Fain Carver, 41, of Highway 140 in Adairsville. In the report, attached to this article, the deputy says Carver refused to exit his truck before opening fire from a large-caliber weapon.

While the officer had heard what may have been shots from a smaller-caliber gun, he reported seeing several muzzle flashes on the driver's side of the truck and hearing five to 10 rounds fired from a larger weapon.

The police officer returned fire at least twice, then Carver yelled that he had been shot. His passenger, 74-year-old Elmus Fain Carver, was sitting in the passenger's seat and a wounded, bleeding Nelson Carver was lying outside the truck with an AR-15 rifle to his side, according to police.

Both were charged in connection with the incident. The younger Carver was released from the hospital and jailed on charges of aggravated assault on a law enforcement officer, reckless conduct, driving in violation of a limited permit and open container.

The older man is accused of being a party to the crime of aggravated assault on a law enforcement officer and reckless conduct.

Authorities say the driver, Nelson Fain Carver, 41, was shot by the deputy, taken by ambulance to Floyd Medical Center and released this morning. He was then jailed on a charge of aggravated assault on a law enforcement officer.

In a press release, Sheriff Clark Millsap said Carver was told by the deputy to place his hands outside his truck during an attempted traffic stop, but stepped out and shot at the lawman.

The officer shot back, striking Carver. Along with the younger Carver, 74-year-old Elmus Fain Carver was arrested and charged with being a party to the crime of suspected aggravated assault on a law enforcement officer.

The investigation is ongoing, and Georgia Bureau of Investigation agents were called in.

A deputy shot a man in the arm in an Adairsville incident.

Police scanner traffic provided by Bartow County Scanner indicates the deputy returned fire at a vehicle at Linwood and Hall Station roads in response to a man's report someone was shooting at him.

The Nissan truck carrying two men had its bright lights on, and the deputy said he could not see the pair. "They’re not being very cooperative," was the next thing he said over the police radio.

"Shots fired, Bartow," he screamed, following a lull in communication as dispatchers tried to reach the officer. "I believe I’m 10-4. I’m not hit."

The driver of the vehicle was shot in the left arm. An ambulance was dispatched to the scene.
